These Terms of Service ("Terms") govern your access to and use of the Cursorio mobile application and web platform (app.cursorio.com), together the "Service", provided by CURSORIO, a French société par actions simplifiée à associé unique (SASU) with share capital of €1,000, registered with the Registre du Commerce et des Sociétés of Cannes under number 913 138 640, with its registered office at 21 rue des Muriers, 06110 Le Cannet, France ("Cursorio", "we", "us", "our"). IMO Company number: 6391845.
By creating an account, accessing or using the Service, you ("you", "User") agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
Cursorio is a professional yacht- and fleet-management platform designed to help yacht owners, managers, captains and crew organize and document onboard operations in real time. Features include, depending on your configuration: a unified dashboard, Hours of Rest (HoR) and crew activity logging, certificate management with expiry alerts, planned maintenance, manual expense and budget tracking, automated monthly reports, AI-assisted budgeting, document storage, administration and safety records.
The Service is intended for professional use by maritime professionals and the organizations that employ or manage them. It is not intended for consumers or for personal, family or household purposes.
2. Eligibility
You must be at least 18 years old and legally able to enter into a contract to use the Service. By using the Service you represent that you meet these requirements and that any information you provide is accurate. Access to Cursorio is currently reserved to Cursorio clients and may be subject to eligibility review.
3. Accounts and roles
3.1 To use the Service you must create an account and provide accurate, current and complete information.
3.2 The Service uses role-based access, which may include roles such as Owner, Manager/Admin, Captain and Collaborator/Crew. Different roles have different permissions. For example, and depending on configuration: a Manager may consolidate a fleet view and audit entries; a Captain may create, edit, delete or override Hours of Rest entries and submit expenses; a Collaborator/Crew member may log their own activities; an Owner may receive consolidated reports. The Service maintains a signed, immutable history of certain actions for audit purposes. The exact permissions of each role are defined within the Service and may evolve.
3.3 You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately at [email protected] of any unauthorized use.
3.4 Where an organization (e.g. a management company or vessel owner) provisions accounts for its personnel, that organization is responsible for managing those users and for the lawful basis of any personal data it asks us to process on its behalf.
4. Acceptable use
You agree not to:
- —use the Service for any unlawful purpose or in violation of any applicable maritime, labour, tax or data-protection law;
- —enter information you know to be false, including falsified Hours of Rest records or financial data;
- —attempt to gain unauthorized access to the Service, other accounts, or our systems;
- —reverse engineer, decompile, copy or resell the Service except as permitted by law;
- —upload malicious code or disrupt the integrity or performance of the Service.
5. Hours of Rest, records and regulatory compliance
5.1 The Service provides tools to record and review working/rest hours and related activities. These tools are intended to assist with documentation and internal compliance workflows (including those connected to the Maritime Labour Convention, 2006).
5.2 You remain solely responsible for the accuracy, completeness and lawful use of the records you create, and for compliance with all applicable regulations, flag-state requirements and the rules of any inspection or audit. The Service is a tool and does not constitute legal, regulatory or compliance advice, nor a guarantee of compliance.
5.3 Records may be created, edited, overridden, deleted or audited according to user roles and permissions. You are responsible for configuring and supervising these permissions appropriately within your organization.
6. Financial features and AI
6.1 The Service lets you manually record expenses, budgets and related financial information for your vessel or fleet, and generates reports from the data you enter. The Service does not currently connect to your bank accounts.
6.2 The Service includes AI-assisted features (for example budget analysis, anomaly detection, forecasting, VAT-recovery suggestions and automated report commentary) based on the data you enter. These outputs are informational and may be inaccurate or incomplete. They do not constitute financial, accounting, tax or legal advice, and must be reviewed by you and, where appropriate, by a qualified professional before you act on them. You remain responsible for your financial, accounting and tax decisions and filings.
7. Price
The Service is currently provided free of charge and does not include in-app purchases. Access may be reserved to Cursorio clients. If we introduce paid plans or in-app purchases in the future, we will update these Terms and, where purchases are made through the Apple App Store or Google Play, the relevant store's payment, renewal and refund rules will apply.
8. Intellectual property
The Service, including its software, design, text, graphics and logos, is owned by CURSORIO or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended professional purpose. You retain ownership of the content and data you submit ("Your Content"), and you grant us the rights needed to host, process and display it solely to operate and improve the Service.
9. Third-party services
The Service relies on third-party providers (e.g. cloud hosting, push notifications, analytics, crash reporting and AI providers). Your use of the Service may be subject to their terms. We are not responsible for third-party services we do not control.
10. Availability, changes and suspension
10.1 We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. Maintenance, updates or factors beyond our control may cause downtime.
10.2 We may modify, suspend or discontinue all or part of the Service, and may suspend or terminate accounts that breach these Terms or that we reasonably believe create risk or legal exposure.
11. Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will meet your requirements or that records will satisfy any specific regulatory standard.
12. Limitation of liability
To the maximum extent permitted by applicable law, CURSORIO shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits, revenue or goodwill, arising out of or related to your use of the Service. Nothing in these Terms excludes liability that cannot be excluded under French law (including in cases of fraud, gross negligence, or harm to life or bodily integrity).
13. Indemnification
You agree to indemnify and hold harmless CURSORIO from any claims, damages or costs arising from your breach of these Terms, your misuse of the Service, or your violation of applicable law or third-party rights.
14. Account deletion and termination
14.1 You may stop using the Service and delete your account at any time from within the app (Settings → Account → Delete account) or by contacting [email protected].
14.2 On deletion, we will delete or anonymize your personal data as described in our Privacy Policy, subject to records we are legally required to retain.
15. Changes to these Terms
We may update these Terms from time to time. We will post the updated version with a new "Last updated" date and, for material changes, take reasonable steps to notify you. Continued use after changes take effect constitutes acceptance.
16. Governing law and jurisdiction
These Terms are governed by French law. Subject to any mandatory rules, any dispute relating to the Service shall be submitted to the competent courts of Cannes, France.
